מסכת חולין פרק יב משנה ג
היתה מעפפת If she was flying,
בזמן שכנפיה נוגעות בקן so long as her wings touch the nest
חיב לשלח one is obligated to send her away,
אין כנפיה נוגעות בקן if her wings do not touch the nest
פטור מלשלח one is exempt from sending her away.
אין שם אלא אפרוח אחד If there is only one chick
או ביצה אחת or one egg
חיב לשלח one is obligated to send her away (even though the Torah mentions only the plural of eggs and chicks),
שנאמר קן as it says "a nest,"
י(דברים כב:ו)י  
קן מכל מקום [meaning] a nest of any type.
היו שם אפרוחין מפרחין If there were fledglings (i.e. chicks that could fly and seek their own food)
או ביצים מוזרות or unfertilized eggs
פטור מלשלח it is exempt from being sent away,
שנאמר as it says
והאם רבצת על האפרחים "and the mother is roosting upon the chicks
או על הביצים or upon the eggs,"

מה אפרוחין בני קימה just as chicks are viable
אף הביצים בני קימה so too the eggs must be viable,
יצאו מוזרות excluding the unfertilized;
ומה הביצים צריכין לאמן and just as eggs require their mother,
אף האפרוחים צריכין לאמן so too the chicks must require their mother,
יצאו מפרחין excluding fledglings.
שלחה וחזרה If he sent her and she returned,
שלחה וחזרה he sent her and she returned,
אפילו ארבעה וחמשה פעמים even four or five times,
חיב לשלח he is required to send her,
שנאמר שלח תשלח as it says "you shall surely send her."

אמר הריני נוטל את האם If he said "I will take the mother
ומשלח את הבנים and send away the children"
חיב לשלח he must send away [the mother] (he cannot take the mother instead of the children),
שנאמר as it says
שלח תשלח את האם "you shall surely send the mother
ואת הבנים תיקח לך and take for you the children."

נטל את הבנים If he took the children [after sending away the mother]
והחזירן לקן and then returned them to the nest
ואחר כך חזרה האם עליהן and after that the mother returned to them,
פטור מלשלח he is exempt from sending her away (as they are now considered to have been prepared).
 

פרק יב משנה ד

הנוטל אם על הבנים One who takes the mother [from] on her children,
רבי יהודה אומר Rabbi Yehuda says
לוקה he is lashed,
ואינו משלח and does not send [her] away,
וחכמים אומרים and the Sages say
משלח ואינו לוקה he sends her away and is not lashed.
זה הכלל This is the rule:
כל מצות בלא תעשה any commandment not to do something
שיש בה קום עשה that has in it an obligation to do something
אין לוקין עליה one is not lashed for.  (Rabbi Yehuda holds that the mitzvah of sending away the mother is only a remedy for having improperly taken her in the first place, while the Sages say that the Torah says that while one may not take away the mother, one may send her away and take her offspring.
