עשרה יוחסין עלו מבבל

Ten genealogical classes came up from Babylon

 כהני לויי ישראלי

Kohens, Levis, and Yisroels,

חללי

Defectives (Kohanim born of a Kohen's forbidden relationship)

גרי וחרורי

converts and freedmen,

ממזרי נתיני

mamzers and Nesins (a race descended from Gibeon who deceptively became converts to Judaism)

שתוקי

children of unknown fatherhood

ואסופי

and foundlings.

כהני לויי וישראלי

Kohens, Levis, and Yisroels,

מתרים לבא זה בזה

are permitted to each other.

Levis, Yisroels, Defectives

גרי וחרורי

converts and freedmen

מתרים לבא זה בזה

are permitted to each other.

גרי וחרורי

Converts and freedmen,

ממזרי ונתיני

mamzers and Nesins,

שתוקי ואסופי

children of unknown fatherhood and foundlings,

כלם מתרין לבא זה בזה

פרק ד משנה ב;

What is a child of unknown fatherhood?

כל שהוא מכיר את אימו

Any who knows his mother

ואינו מכיר את אביו

but does not know his father.

אסופי

A foundling

כל שנאסף מן השוק

is any who is brought in from the public square

ואינו מכיר

and does not know

לא את אביו ולא את אימו 

neither his father nor his mother.

אבא שאול היה קורא לשתוקי

Abba Shaul would call a child of unknown fatherhood

בדוקי

a beduki.

משנה א

עשרה יוחסין עלו מבבל - Due to a lack of an established סנהדרין in בבל, when returning to ארץ ישראל Ezra brought the problematic groups with him to ensure that they would not intermarry.

חללי - For example, the offspring of a widow to a כהן גדול, or a divorcee to a כהן הדיוט.

וחרורי - A freed עבד כנעני is regarded as a גר.

נתיני - There is disagreement if the prohibition for this group was מדאורייתא or מדרבנן.

שתוקי ואסופי - Due to their circumstances, such person's heritage is suspect.

גרי וחרורי ממזרי ונתיני שתוקי ואסופי כלם מתרין לבא זה בזה - The reason that a ממזר is permitted to שתוקי or אסופי is based on an iteration of the term קהל in the תורה when talking about the prohibition of intermarrying with ממזרים; similarly converts and freedmen did not come from the קהל, and so they too could marry.  The reason why נתינים were permitted is less clear, and is a מחלוקת ראשונים.

 

משנה ב

שתוקי - So called because their mothers would silence (שתוק) them when they inquired about their fathers.

בדוקי - He would allow an investigation (בדיקה) to be made into the mother's claims  to legitimize the child.
